Suruhanjaya Hak Asasi Manusia Malaysia (Suruhanjaya) memandang berat dan bimbang dengan kenyataan terkini yang dilaporkan dibuat oleh Peguam Negeri Sabah bahawa Ordinan Tanah Sabah (OTS) yang berkuatkuasa pada tahun 1930 tidak membenarkan wujudnya Hak Tanah Adat yang baru di Sabah. Menurut Peguam Negeri Sabah tidak ada peruntukan dalam OTS bagi anak negeri untuk membuat penempatan selepas 1930 dan menuntut Hak Tanah Adat, yang mana ianya jelas bercanggah dengan kedudukan Hak Tanah Adat yang merupakan hak asas masyarakat Orang Asal/Asli sepertimana dijamin dalam Perlembagaan Persekutuan.

The Human Rights Commission of Malaysia (the Commission) views with great concern and disquiet over the recent statements reportedly made by the Sabah Attorney-General that the Sabah Land Ordinance (SLO) that came into force in 1930 does not allow for the creation of fresh Native Customary Rights (NCR) to land in Sabah. According to the Sabah Attorney-General, there is no provision in the SLO for natives to go into occupation of land after 1930 and claiming NCR on it, which clearly contradicts the position that NCR to land is a fundamental right of indigenous communities guaranteed under our Federal Constitution.

FELDA to return 306,000 acres of land to the State

Federal Land Development Authority (FELDA) should return 306,000 acres of land to the State of Sabah because FELDA had breach its promise and reneged from its obligations to develop the land given to FELDA intended to serve the interest of the people of Sabah.

At the same time, Sabah BN State Government should be held responsible for its failure to protect the interest of the State and its people in the land settlement schemes undertaken by FELDA.

KOTA KINABALU: The much anticipated federal government’s green light for a Royal Commission of Inquiry (RCI) on how Filipino and Indonesian illegal immigrants gained Malaysian documents in Sabah has been met with suspicion by the State Reform Party (Star).

Star state chapter chairman Jeffrey Kitingan, who has been demanding an investigation for years, said though Sabahans welcomed the setting up of the RCI, the government must ensure its sincerity and integrity are reflected in the RCI.

He said he would like the federal leaders to consider a few points that are vital to safeguarding the country’s and the RCI’s own integrity.

KENINGAU: Pelancaran Parti Reformasi Negeri (STAR) untuk kawasan parlimen Keningau akan di adakan esok (11 Februari) di sini.

Pengerusi Penganjur pelancaran itu, Dr. Nicholas Guntobon, memaklumkan bahawa tempat pelancaran itu adalah di Restoran Pelancongan, di Jalan Keningau-Tenom, lebih kurang dua kilometer dari pekan Keningau. “Kita akan mulakan pada jam 1.30 petang,” katanya. “Dan kami menjemput semua penyokong dan sesiapa juga yang berminat mendengar rasional kenapa kita harus berada dalam STAR seperti yang akan dihuraikan oleh Pengerusi STAR, Datuk Dr. Jeffrey Kitingan, dalam ucapan beliau.”

Pelancaran di Keningau tersebut adalah yang keempat bagi kawasan-kawasan parliament selepas Kota Marudu, Pitas, dan Kota Belud. Guntobon menjangka satu kehadiran yang lebih ramai dari biasa memandangkan Keningau adalah tempat asal Dr. Jeffrey. “Saya tidak hairan jika jumlah yang hadir akan lebih dari 4,000 orang yang telah membanjiri bangunan Hongkod bagi pelancaran parti peringkat negeri bulan lalu,” katanya.

KENINGAU: The launching of the State Reform Party (STAR) for the Keningau parliamentary constituency is to be held here, tomorrow.

Organising Chairman for the event, Dr. Nicholas Guntobon, announced that the venue for the event will be at the Restoran Pelancongan, located by the Keningau-Tenom road about two kilometres from Keningau town. “We will kick off at about 1.30 p.m.,” he said. “And we invite all supporters and those wishing to hear the rationales for choosing STAR which will be elaborated by our Chairman, Datuk Dr. Jeffrey Kitingan in his speech.”

The Keningau launch is the fourth in the series for district launches, after the Kota Marudu, Pitas, and Kota Belud. Guntobon expects an especially large crowd considering the constituency is the home ground of Jeffrey. “I wouldn’t be surprised if the attendance will be higher than the 4,000 crowd at the party’s launch at Hongkod lKoisaan last month,” he said.

MoCS is back, to launch anti-corruption crusade

After a six-month hiatus, the Movement for Change, Sarawak (MoCS) will resume its work in Sarawak come Feb 13.

“We will continue where we left off. The Red Rally last August 13 was the final event of our one-year campaign to oust Chief Minister Abdul Taib Mahmud. Family has two more S’pore suites, claims PKR

PETALING JAYA: Following allegations that the family of Datuk Seri Shahrizat Abdul Jalil owns condominium units in Kuala Lumpur and Singapore, the PKR has further claimed the family has two more luxury suites in the republic.

PKR strategic director Rafizi Ramli said the two other units in Singapore's Marina Bay, with a price tag of $S14.29mil (or RM34.6mil), were bought on May 27, 2010.

He alleged the Marina Bay suites were bought under the names of National Feedlot Corporation chairman Datuk Dr Mohamed Salleh Ismail and NFC chief executive officer Wan Shahinur Izran Salleh.

Tun Musa Hitam had just shown his amusement and low opinion about this new popular terminology called “winnable candidates.” He said that it is not up to the leaders to decide but up to the people! And how true!

Personally, I have wondered how to determine if a candidate is “winnable” or not. Anyway, I am also not comfortable with the word “winnable” in this context because “winnable” actually means “can be won”. But what they mean is “able to win” (boleh menang) a phrase which has no single word to express in the English language. So we are stuck with the awkward “winnable”.

The Sultan of Brunei who originally ruled Sabah ceded it to the Sultan of Sulu in 1704 as a reward for helping suppress an uprising in his domain. In 1878, the Sultan's successor, Jamalul Azam, leased the territory to William Cowie and Baron von Overbeck for 5,000 Malaysian Dollars.

Overbeck was then the Austrian consul at Hong Kong and former local manager of the British opium firm of Dent and Company.


This territory rightfully belongs to the Sulu Sultan

Setelah Perjanjian Malaysia ditandatangani oleh wilayah Singapura, Malaya, Sabah dan Sarawak, maka dunia mencipta satu lagi sejarah selepas perang dunia di asia, ia itu penyatuan wilayah menjadi sebuah negara bernama Malaysia.

Agak sedih kerana tanpa pengetahuan Sabah dan Sarawak, Singapura samada dikeluarkan atau menarik balik atau sememangnya telah bermain wayang untuk memikat Sabah dan Sarawak supaya bersetuju membentuk Malaysia. Suatu tanda tanya yang tidak pernah terjawab samada oleh Singapura atau Malaya, ialah kenapa wilayah rakan kongsi Sabah dan Sarawak tidak dijemput berbincang mengenai Singapura tidak bersama-sama Malaysia.

The Barisan Nasional had said it many times that they will “answer the opposition’s lies” (menjawab tohmahan-tohmahan pembangkang) and recently we are told that Sabah BN will have its own body to work on these answers. As a member of the opposition I am naturally challenged about such so-called lies and I am very interested to hear what BN has to say about a few ‘lies’ that we have been repeating over the years. I would therefore like to volunteer my services to this body (to answer our lies) by providing a list of such lies. I of course expect this body to answer all these lies as clearly and as convincingly as they can as soon as possible:

Sabah duo on the run

KUALA LUMPUR: A 41-year-old Sabah politician, who is a Datuk and an Umno division assistant chief, has fled the state after learning that his office was raided over false claims involving a RM43mil contract for mechanical and electrical maintenance work with Universiti Malaysia Sabah (UMS).

A department director at the university is also being investigated and his office was raided as well by Malaysian Anti-Corruption Commission (MACC) officers.

He is also said to have fled the state.

Sources said the two men had allegedly made false claims amounting to millions of ringgit although no work was done since the contract was awarded 36 months ago.

What a shame that Malaysians at home missed a lively, stimulating and exciting debate because this is what intellectual discourse is all about. No slanging matches. No name-calling atypical of the usual parliamentary exchanges across the floor of the Dewan Rakyat.

KOTA KINABALU: An inaugural meeting to form a United Borneo Alliance (UBA) succeeded only to have an “agreement in principle” as one of the participants, the Sabah Progressive Party (SAPP), wanted time to deliberate on it before formalising their participation.

The meeting yesterday saw the participation of representatives from three local groupings – State Reform Party (STAR), SAPP and the yet-to-be-registered Usno Baru.

It was chaired by Ismail Gimbad, 71, a former Sorob (now Kadamaian) assemblyman who is not a member of any of the parties.

KOTA KINABALU: Corruption and abuse of power in the Sabah Native Courts is so bad that even Chinese nationals from Hong Kong and Taiwan have managed to become “natives” in the state, according to Chief Judge of the High Court of Sabah and Sarawak Richard Malanjum.

“There are citizens from Hong Kong and Taiwan who have been given the status of native (anak negeri). Judges of the Native Courts gave them the ‘Sijil Anak Negeri’. There are cases, it is a fact.

KOTA KINABALU: In what appears to be an open confrontation for change, ‘hundreds of Umno members’ in P. 176 Kimanis are demanding that a new candidate be allowed to contest in place of Datuk Anifah Aman to represent the P. 176 Kimanis constitutency in the next general election.

In an interview here yesterday, leaders of the group which are mobilising what they call a Leadership Transformation Movement, said they are demanding for this change because Anifah, who is Malaysia’s current Foreign Minister has been in the Member of Parliament for the area too long and it is time to replace him. So far three demonstrations to voice out this demand had been held, the first in Dewan Kg. Pimping on January 21, 2012, the second in Dewan Lama Pekan Bongawan on the following day, and the third for two days on January 23 to 24 in Dindong, Kg. Bambangan, Membakut.

Malaysian Bar deplores arrest of Orang Asli and lawyer, abuse of police powers, in Gua Musang

KUALA LUMPUR: The Malaysian Bar condemns the arbitrary arrest, in Gua Musang on 28 January 2012, of 13 Orang Asli of the Temiar tribe who had gathered peacefully to protest and blockade the alleged incessant illegal encroachment onto, and logging of, their ancestral lands. Although the Temiar had been assured that the state authorities would resolve their grievances by mid-January, the alleged intrusion and logging activities had continued unabated. The police reportedly burned down the blockade, detained/arrested the Temiar, and prevented family members of those arrested from accompanying them to the detention centre. The detained Temiar were said to have been denied food and legal representation, and questioned for several hours before being released.

THE PROMISES being made by the opposition leaders are so attractive and reasonable, and the support the opposition is getting from the people is now so strong, that the BN leaders are genuinely worried.

The recent visit by Datuk Seri Anwar Ibrahim this week was even more troublesome for them because Anwar made new additional promises that are causing the people to think again more positively about their future.

Last weekend in Kota Belud, the so-called birth-place of Umno in Sabah, the party’s state deputy president Salleh Said Keruak gave a stinging reminder to possible party-detractors.

He said those who were contemplating ditching Umno if they are not re-nominated in the coming general election, would be ‘ignored’.

Salleh, who is a local boy, issued this warning during a special meeting with a group of Umno’s Kadazandusun leaders from Kadamaian.
