Malaysia has an unwritten Constitution based on the Batu Sumpah and other constitutional documents like the written Constitution of Malaya, Malaysia Agreement, the Malaysia Bill, the Inter Governmental Committee Report, the Cobbold Commission Report, the 20/18 Points, Adat, the UN's Informal Survey on Malaysia, the Sabah and Sarawak Constitutions, the Dent/Overbeck Agreements with the Sultans of Brunei and Sulu, the Madrid Protocol of 1885, the Singapore/Malaya Merger through Malaysia proposal, the various British Committees which studied the formation of Malaysia etc etc long before Tunku Abdul Rahman announced it in May 1961 at a meeting with the Foreign Correspondents Association in Singapore.
Shafie puts foot in mouth about Sabah oil and basic politics

KOTA KINABALU: In Datuk Shafie Apdal’s comment about the opposition’s
promise to give 20% royalty for its oil if it was voted to power, he stressed only two important points,
that is, Sabah shouldn’t take 20%“because it needs to share its wealth”
and “the opposition should not makes promises that causes rift among
the people.”
I
have one thing to say about what he said: these are some of the dumbest
and most idiotic statements we have heard in the political history of Sabah.
It is no better than when Datuk Salleh Said Keruak said the people
should blame themselves for the increase in illegal immigrants in Sabah, or when Tun Mahathir said the illegals in Sabah should be given citizenships because they can speak Bahasa Malaysia!

Beliau berkata, selagi pemerintahan negara ini yang mengamalkan sistem demokrasi, rakyat berhak menentukan siapa yang bakal meneraju negara dan tiada siapa boleh menghalang kemahuan mereka termasuk Najib dan Mahathir.

The Yayasan Islam Sabah (YIS) appears to be getting way ahead of itself in pontificating sanctimoniously on its four "theories", for want of a better term, in the Daily Express report, "YIS: Those already having documents need not worry", on Wed this week.
The first YIS theory is that Malaysian citizens in Sabah need not fear about their citizenship rights as long as their identity card was issued by the National Registration Department (NRD).
This is a fallacy in law.
The Federal Government cannot issue Special Passes, temporary residence permits (green cards), permanent residence status (red cards) or citizenships to foreigners in Sabah without the prior written recommendation and consent of the state government, which must be the initiating party, on a case-by-case basis.

KEMABONG: Pemimpin terdahulu telah membuat keputusan tergesa-gesa dalam persetujuan pembentukan Malaysia melalui penyatuan Tanah Melayu, Sabah, Sarawak dan Singapura. Ini adalah antara punca utama hak asasi rakyat Sabah sepertimana yang terkandung dalam 20 Perkara mudah dimanipulasikan oleh pihak persekutuan.
Negara Brunei dan Singapura yang kini jauh lebih maju dan pesat membangun malah memiliki ekonomi yang jauh lebih baik berbanding Sabah selepas mereka tidak meneruskan untuk bersama dalam pembentukkan Malaysia pada ketika itu (Singapura keluar dari Malaysia tahun 1965).
