Sabah security in fits-and-starts

Sabah security in fits-and-starts just won’t do.

We are now told that the Ministry of Defence (Mindef) will be responsible for security along the newly-created Eastern Sabah Security Command (ESSCOM) stretching from Kudat in the North to Tawau in the south-east corner, past the wolf’s mouth segment on the map of the territory.

Mindef takes over from the all-powerful Prime Minister’s Department (PMD) which had hitherto been apparently responsible for security in Sabah. Indeed, it appears that the reason why Malaysian security forces have been slow in responding to the Lahad Datu intrusion and Standoff may be more due to the fact that the PMD was solely responsible for security in Sabah.
Both these items, Mindef and PMD, are news to Sabahans and probably most Malaysians. The PMD, according to 2010 figures, employed 43, 544 people and had a budget of RM 3.9 billion. It was a hyper ministry, but labeled Department, a misnomer.

We still don’t know whether the PMD would be responsible for security in the rest of Sabah and who is responsible for the security situation in neighbouring Sarawak which has a long border, albeit for the most part difficult mountainous terrain in jungled territory, with Kalimantan.

Nur Misuari should be given benefit of the doubt
In any case the PMD has no business getting involved directly in security matters, internal and security, except through the National Security Council (NSC) headed by the Prime Minister.

Is it any wonder therefore that the intelligence services, both Special Branch and Military, have been caught “napping” in a way on the Lahad Datu intrusion by terrorists from the nearby Sulu islands. In fact, they were not napping at all. They weren’t responsible for the security of Sabah. No wonder illegal immigrants continued flooding into Sabahover the decades as Putrajaya, by all accounts, looked the other way.

One exception was the period after the Sipadan hostage incident in 1999-2000 when Ramli Yusuff became Commissioner of Sabah from 2001- 2004.Upon the specific instructions of then Chief Minister (2001-2003) Chong Kah Kiat, Ramli formed a Special Task Force with Army Commander of Sabah, Brig-Gen Mohd Yassin, to expel thousands of illegal immigrants from the Philippines and Indonesia in particular.

On another score, we must take Nur Misuari’s statements on Malaysia’s involvement in training the Moro National Liberation Front (MNLF) seriously. Of course, it’s an open secret in Sabah that not only Malaysia but Libya from the days of the Mustapha regime has been arming the MNLF. But this is the first time that Nur Misuari himself has directly admitted what has been only openly talked about in the warongs for decades.Between Nur Misuari’s admission and former Prime Minister Mahathir Mohamad’s outright self-serving denial, the benefit of the doubt can be given to the former.

Parliament should act on Eastern Sabah Security Zone
Taking the announcement on ESSCOM at face value, it seems that not everything is above board. It has often been said that a Government, on paper, has the power to do anything, even the “illegal” if necessary, and detractors can resort to the Court by way of an Application for Leave to secure a Judicial Review either by Mandamus (to compel) or Certiorari (to squash) any errant Government decision by administrative law – not law at all but policy in action -- on any matters of state.

Questions abound!

Under the Federal Constitution, the Prime Minister has no legislative power, not even in an emergency situation, points out Star chairman Jeffrey Kitingan, for one.

Apparently, the power lies with the Yang Di Pertuan Agong and Parliament.

Under Article 150, “if the Yang Di Pertuan Agong is satisfied that a grave emergency exists whereby the security, or the economic life, or public order in the Federation or any part thereof is threatened, he may issue a Proclamation of Emergency making therein a declaration to that effect.”

Under Article 149, it is for Parliament to pass the necessary laws if there is any “action has been taken or threatened by any substantial body of persons, whether inside or outside the Federation -…(f) which is prejudicial to public order in, or the security of, the Federation or any part thereof,”

Long-term diplomatic and political solution for Sabah
The area from Kudat to Tawau involves 11 Parliamentary seats and 27 state seats. The Parliamentary seats affect the whole of Malaysia, not just Sabah.

No doubt the internal security problems and international issues facing Sabah, including the claim to Sabah or parts of it by the Philippines and/or Sulu, culminated in the Lahad Datu Standoff.

Sabah requires require a long-term diplomatic and political solution, not a military one, a point which is gathering consensus among most people in the state.

The United Nations (UN), whose Secretary-General has urged the Malaysian government to find an amicable solution in the wake of Lahad Datu, should be brought in to help resolve issues involving Sabah in Malaysia.

No Referendum was held on Malaysia in Sabah, Sarawak, Brunei and Malaya.The Cobbold Commission was not a Referendum of the people but a sampling survey of community leaders with only Suluk and Bajau leaders agreeing to Malaysia. The Malayan and British Governments dragged Sabah and Sarawak into Malaysia on 16 Sept, 1963 AFTER both Nations had obtained their independence on 31 Aug, 1963 and 22 July, 1963 respectively.

Security in Malaysia, for Sabah, Sarawak and Brunei, -- against the crocodiles in the region viz. Philippines and Indonesia -- was an afterthought when it emerged that others were reaping the real benefitsof Federation and not the people in Borneo: Britain could consolidate its commercial empire in the region through Malaysia; Singapore obtained independence through merger with Malaya via Malaysia; and the Malaya-led and dominated Federal Government virtually had unlimited access to the resources and revenue of three potentially rich Nations in Borneo.

Brunei staying out of Malaysia at the 11th hour floored the argument that the Orang Asal populations of Borneo were needed to facilitate the merger between Chinese-majority Singapore and non-Malay majority Malaya.

Not surprisingly, Singapore was expelled from Malaysia two years later as the Malay-speaking communities in Malaya felt demographically threatened by Singapore despite the added numbers of the Orang Asal in Sabah and Sarawak.

However, Sabah and Sarawak were not likewise allowed to exit Malaysia.

These and other matters, including the so-called Sulu claim, should be resolved by the UN Security Council lest there be an even greater flare-up in Borneo one day when the Orang Asal react violently against their marginalization and disenfranchisement given the continuing influx of illegal immigrants into their countries.

      1. UMNO has restored ALL Sabah Sarawak rights in the 18 and 20 Points Agreement,

      2. Written up a proper new Malaysian constitutions which enshrines freedom equality and liberty! And done with full participation of the Borneo people and not use the substitute Malayan Constitution!

      3. In line with the above: UMNO has dismantled the NEP apartheid system.

      4. Desegregated the Sabah Sarawak civil service with Borneonisation (that will be quickly filled by educated and able Borneo people)

      5. Desegregated the whole economy and educational facilities,

      6. Scrubbed all repressive laws and lift idiot religious bans on use of mere words,

      7. Withdrawn Malayan occupation army from Sabah and Sarawak and let them form their own armed forces.

      These points are fundamental for equal partnership in Malaysia! But Malaya will never act on any of them since it is just a REPLACEMENT COLONIAL MASTER!

      What we really want is not to fix up a failed Malaysia or have a referendum but to take our countries out of Malaysia for real independence- straight away!

      And if there is to be any referendum it will be one for Sabah and Sarawak independence from Malaya.

      And if you UMNO cyber hackers cannot answer that just shut up!

      A new crisis in southern Philippines is underway - it is a conflict with Malaysia over a province called Sabah.
      Armed Filipino men are challenging the Malaysian government’s power over the province, claiming that this land belongs to the Sultan of Sulu who lives in the Philippines. 
      But the implications here could be severe for the region.
      At stake could be the peace deal between the government of the Philippines and the Moro Islamic Liberation Front’s (MILF) leader Ibrahim Murad. The deal was designed to bring peace to Mindanao and allow the fighters there to build a semi-autonomous Islamic state, to be called Bangsamoro.
       
      The party that brokered the deal was Malaysia. Its Muslim-dominated government used its influence with the Islamic fighters in Mindanao to bring the parties together. But now, there are allegations that members of the Moro National Liberation Front (MNLF), the original Islamic insurgency group, feels sidetracked and has allowed some of its men to fight the Malaysian government presence in Sabah.
       
      Which brings us back to where the conflict in Mindanao started -  it is in places like this that the resistance against what they call Philippine colonialism was nursed.

  9. Lahad Datu: Sabah MMEA now under Mindef
    Sabah's Malaysian Maritime Enforcement Agency (MMEA) has been placed under the command of the Defence Ministry to address the security issues relating to the state's porous border.

    Minister Datuk Seri Dr Zahid Hamidi said the handover was made official on March 8 following an appointment letter from the Prime Minister's Office, signed by Deputy Prime Minister Tan Sri Muhyiddin Yassin.

      “This move will only be for the Sabah MMEA and is needed to coordinate operations with the navy in protecting Sabah's border.       “We are facing a matter of intrusions that are happening over 1,400km along the east coast of Sabah. We may need to add assets, not only for the land-based armed force but also for the coast guards,” he said.

      In line with the setting up of the Special Security Area (ESSCOM), Dr Zahid Hamidi said the necessary assets would be procured for the MMEA and the navy to secure the coast.

      However, he did not specify these assets.

    3. In Kota Kinabalu, Home Minister Datuk Seri Hishammuddin Tun Hussein said top civil servants, including Chief Secretary to the Government Datuk Seri Ali Hamsa, would be in Sabah to further finalise details of ESSCOM.

      He said Ali would be accompanied by senior Treasury officials as well as Implementation and Coordination Unit (ICU) counterparts.

      “They will be here to hear the needs of those operating from the ground,” said Hishammuddin while on a visit to the east coast Sandakan district.

      He said his visit had enabled him to hear directly from police officers of the VAT69 commando unit, General Operations Force and Marine Force units.

  11. Lahad Datu: Back to school for 50 pupils in Tanjung Labian

    It's back to school after nearly two weeks for over 50 pupils displaced by the ongoing offensive to flush out terrorist in Tanjung Labian.

    Only this time, the pupils of SK Tanjung Labian are attending classes in a makeshift tent outside their Embara Budi shelter home and teachers have begun their lessons as usual.

    SK Tanjung Labian senior assistant Abdul Amin said this was an initiative by teachers of the school for their students who missed classes for almost two weeks since the start of operation to forcibly flush out the gunmen began on March 1.

  12. Lahad Datu: Back to school for 50 pupils in Tanjung Labian

    “We have 10 teachers teaching students from pre-school level to Primary Six. Since the numbers of students from each standard is small, we group them and teach accordingly,” he said yesterday morning.

    He said four core subjects English, Bahasa Malaysia, Science, and Maths were being taught.

    Meanwhile, co-curriculum senior assistant Osman Abdul Rahman recalled the day they were out in Lahad Datu town for the school's sports day when their activities were halted with news of the shootings and terrorists escaping the police cordon.

    “Five teachers and nine students from the school were in town for the event on March 1. We immediately stopped our activities and found a hotel to spend the night before getting further information on whether we could go back and get our belongings,” he said.

  13. Lahad Datu: Back to school for 50 pupils in Tanjung Labian

    The pupils returned to Tanjung Labian and met their families the next day and had since been absent from school.

    Nine-year-old Alepijun Jul Adzmi was happy to start class again but was not upbeat with the situation.

    “I don't like it here because it is not in a building and it is raining,” he said while clutching an English language exercise book.

    Their first day back to school started with the singing of the national, state and school anthems followed by prayers.

      It is revealed by Malaysia Today that in 1994 UMNO paid the terrorist group ABU SAAYAFF to assist in transporting 1 million illegals into Sabah to create instant voters to oust the PBS Government.

      "On Monday, 26 February 2007, the Parliament Select Committee heard the testimonies of various people who had once been detained under Malaysia's draconian and dreaded Internal Security Act (ISA). These people, who used to walk in the corridors of power, were detained under the ISA because they once worked for the government and their government job was to 'import' an estimated one million Muslims from the countries neighbouring Sabah and issue them with Malaysian identity cards so as to flood the state with Muslim voters. The specific purpose of this clandestine operation was to dilute the Christian voters in Sabah so that Umno could topple the Christian-dominated PBS government of Pairin Kitingan.

      The testimonies of these ex-ISA detainees was of course not made public but Malaysia Today found out that their testimonies revealed a partnership that was established between Umno and the Abu Sayyaf Group (ASG) of the Philippines. But the partnership went terribly wrong when the Umno nominees who were entrusted with the job of paying off Umno's Abu Sayyaf partners never delivered the money.
      To 'encourage' the very recalcitrant Umno to pay its extremely long outstanding debt, the Abu Sayyaf Group raided Sipadan and Pandanan islands off the coast of Sabah in 2000 and kidnapped 24 Malaysians and foreigners whom they held for ransom as 'security' for the debt. ..

      Subsequently, Umno had no choice but to pay the money it owed the Abu Sayyaf Group to secure the release of the hostages. But that is not all. The Malaysian government denied it had paid the Abu Sayyaf Group any money to secure the release of the hostages. This was true of course because the money came from Libya, not from Malaysia. However, while Libya paid USD100 million, only USD23 million reached the Abu Sayyaf Group. What happened to the balance of USD77 million? Only one man, Aziz Shamsuddin, can reveal what happened to that money.

      In fact, earlier, Libya had given Umno USD38 million to pay the Abu Sayyaf Group their fees to bring in the one million new voters into Sabah -- who were subsequently all issued with Malaysian identity cards and which eventually resulted in the defeat of PBS in March 1994 and the emergence of Umno thereafter. But this money too disappeared and Abu Sayyaf never received what they had been promised. So that makes roughly USD115 million in total that has disappeared.

      Malaysia Today will trace the events and probe into what happened in 2000 and the role Umno played in securing the services of the Abu Sayyaf Group to kick out the PBS Christian government from Sabah and eventually bring the state under direct Umno control from Kuala Lumpur. And, with that, the federalisation of Sabah was complete and never again would the state be able to exercise its limited autonomy promised to the state when they opted to join the Federation of Malaysia together with Sarawak and Singapore. "

  29. KOTA KINABALU: Six police stations and three more customs, immigration and quarantine stations are to be established within a month in the Eastern Sabah Security Command (Esscom) area, Chief Secretary to the Government Datuk Seri Dr Ali Hamsa said yesterday.

  30. SANDAKAN: As head of the Sabah Government, Chief Minister Datuk Seri Musa Aman said he would continue defending the peace and sovereignty in the state from foreign encroachment.
    He said the recent intrusion by Sulu terrorists from southern Philippines in Lahad Datu, which claimed the lives of 10 members of the Malaysian security forces, would not dampen the spirit of the security forces.

    ANWAR telah menggunakan hubungan lamanya dengan Nur Misuari, Pengerusi MNLF dan mantan Gabenor Mindanao yang dipecat oleh Kerajaan Filiphina kerana penyelewengan kuasa dan Rasuah.     Kedua-dua Presiden ini anti umat Islam di selatan Filipina. Walaupun Anwar pernah menjadi TPM dan bersahabat rapat dengan Presiden yang terkenal dengan kaki minum dan kaki rasuah ini, namun Anwar gagal menghalang Estrada daripada menghantar Tentera Filipina untuk menghapuskan pejuang-pejuang Islam di Selatan Filipina.

  83. Mungkin secara kebetulan, pada 7 Mac 2013, selepas RASCOM dibubar, putera kepada pemimpin yang mengisytiharkan penubuhan RASCOM, mengumumkan pula penubuhan sebuah Kawasan Keselamatan Khas (KKK) untuk pantai timur Sabah.

ESSCOM ditubuhkan berikutan pencerobohan yang dilakukan ada 12 Feb oleh kira-kira 150 pengganas Sulu dari selatan Filipina, yang mendarat secara berperingkat di Silabukan dan Sungai Merah, berhampiran Kampung Tanduo di Felda Sahabat 17, kira-kira 110 km dari Lahad Datu, dengan menaiki bot tradisional yang lazimnya digunakan dalam kegiatan perniagaan tukar barang.

  94. Saya yakin, banyak yang ESSCOM boleh pelajari daripada pendekatan dan pengalaman RASCOM, pertama, kerana kedua-duanya merupakan kawasan keselamatan. Mungkin struktur ESSCOM sedikit berbeza, tapi kebanyakan objektif dan unsurnya mencerminkan tentang RASCOM.

  95. Kedua, ia berkaitan kerjasama dan operasi antara agensi. Ia diperintah oleh seorang orang awam, manakala tentera dan polis akan melaksanakaan tugas penguatkuasaan. Komponen sivilnya, termasuk pihak berkuasa tempatan dan agensi negeri serta persekutuan yang berkenaan, boleh diberi tugas yang tidak melibatkan pertempuran, tetapi tidak kurang pentingnya iaitu perkhidmatan pembangunan masyarakat untuk mewujudkan pertumbuhan dan kemakmuran di kawasan berkenaan.

    It was attended by Inspector-General of Police Tan Sri Ismail Omar, Chief of Defence Forces Gen Tan Sri Zulkifeli Mohd Zin and representatives of the relevant departments and agencies, including the Malaysian Maritime Enforcement Agency (MMEA).

    Ali said the enhancement of the capability and capacity of the armed forces and the police force was the main priority towards the realisation of the Esscom.

    The government viewed the matter with urgency as it was committed to maintaining security in Sabah, he said.

  102. Ali said that for the long term, the government was looking at more developmental areas, including housing and some infrastructure development.

    “The battalions required by the army and the police will also be coming in mid term. But for the immediate term, they have some mechanism where other methods are used,” he said.

    Asked on the overall budget for the whole operation of the Esscom, Ali said he had asked all the relevant parties to come up with their immediate and long-term plans or needs.

    “I think that in terms of budget, the federal government will allocate that … it’s an urgent matter for us,” he said.

  103. Asked to elaborate on the appointment of the Esscom CEO, he said: “The exact name (of the post), we are not sure yet but that looks like a closer name, chief executive officer, it sounds better.

    “He will coordinate all the police, army and all the civilian departments. There are a few candidates.

    “Let the state (Sabah government) put forward some candidates and then we will choose one,” he said, adding that the next meeting of Esscom would be in Putrajaya tomorrow.
